EAT rules in favour of firefighters appeal in pensions age discrimination case

first_imgThe Employment Appeal Tribunal (EAT) has ruled in favour of firefighters who appealed an Employment Tribunal (ET) decision which found that a government move to justify changes to firefighters’ pension arrangements was not age discriminatory.The case, Ms R Sargeant and others v London Fire and Emergency Planning Authority and others, regards firefighters who brought age discrimination claims following the introduction of the 2015 Firefighters’ Pension Scheme (FPS). On 1 April 2015, the FPS changed from a final salary arrangement to a career average revalued earnings (Care) scheme.The firefighters’ argument centres around transitional provisions which permitted active members of the FPS who were born on or before 1 April 1967 to remain in the scheme and receive full protection. Active members born between 1 April 1967 and 2 April 1971 were entitled to tapered protection under the transitional provisions, which allowed them to remain in the FPS for an extra 53 days for each month by which their age on 1 April 2012 was over 41, while active members born after 1 April 1971 were not entitled to transitional provisions, but are transferred to the new pension scheme, unless they decide to opt out of pensionable service. The firefighters claimed that this discriminates against younger employees on the grounds of age, as the new pension arrangement is less advantageous than the previous provision.During the tribunal proceedings, the government stated that it is legitimate to provide protection for members who are closer to retirement age.The ET concluded that the introduction of the new pension scheme was a social policy aim of the government.EAT has granted the firefighters’ appeal regarding equal pay and indirect discrimination on the basis that the ET did not apply proper scrutiny to the assertions of proportionality. Although the ET applied decisions made by the European Court of Justice (ECJ) and the Court of Justice of the European Union (CJEU) when making its decision, the EAT found that the ruling ET employment judge did not apply the level of scrutiny described in domestic case lawEAT agreed with the ET in respect that the government was pursuing legitimate aims in devising and implementing the transitional arrangements for the new pension scheme, even though these had a discriminatory impact on the grounds of age. The court emphasised that it was not the pension scheme changes that were being brought under question, but the transitional provisions.The EAT will refer the case back to a tribunal.Sir Alan Wilkie, who ruled over the proceedings, stated in the court documents: “In my judgement, the employment judge’s decision on the issue of legitimate aims was correct, did not contain any error of law so the appeals on those grounds fail. She did, however, err in law in her consideration of the question of whether the means were proportionate for achieving the legitimate aims and, accordingly, the appellants’ appeal must be upheld in that respect.”last_img read more

To be specific, Microsoft is concentrating on improving frame rates, according to Xbox head Phil Spencer”I think the area that we really want to focus on next generation is frame rate and playability of the games,” Spencer told CNET sister site GameSpot in a series of exclusive interviews. “Ensuring that the games load incredibly fast, ensuring that the game is running at the highest frame rate possible.”The idea of “playability” is quite nebulous, but Spencer seems to be referring to the notion of games running as smoothly as high-end PCs and reducing loads times as much as possible. first_imgOn what turned out to be a pretty bad day in office, five-time world champion Anand went down rather tamely in the second game on Sunday and now trails 0.5-1.5 in the 12-game match. Anand’s body language also suggested that the king is currently down especially in the light of the fact that the opening had gone quite well for the Indian ace in both the games. However, as was the case in the last world championship match, Carlsen tuned the position of both games to his liking after some time and while Anand salvaged a half point in the first game, in the second he never got a chance. Also Read – Khel Ratna for Deepa and Bajrang, Arjuna for JadejaAnand looked more tentative than Carlsen and it was hesitation that cost him dearly in the second game.To his credit, Carlsen was at his best and did what he has mastered against top class opponents. Both put and call are exercisable at the same price of €98.9 million, but the price could rise to up to €113.5 million if Sonaecom is involved in a transaction that sees further consolidation or restructuring of the Portuguese telecom market.In December, Portuguese pay TV leader Zon Multimédia signed an agreement that would see it merge Sonaecom’s telco unit Optimus into its business. award.Images of the front entrance to the prime minister’s home and offices – with its two steps to the front door – are shown every day all over the world.But despite staff needing to bring out a portable ramp if a wheelchair-user wants to enter the grade I listed building through the front entrance, 10 Downing Street was presented with an award at last month’s Blue Badge Style Awards.The awards recognise venues that have “made an effort to attract guests with disabilities”, and those nominated are rated on their style, facilities and accessibility, with other winners including the Ritz Carlton in Wolfsburg, Germany, the Beaumont Hotel in Mayfair, and the Dandelyan cocktail bar on London’s South Bank.The citation for the “above and beyond” award said that 10 Downing Street had “pulled out all the stops” on access.Historic England – the government-sponsored public body responsible for “championing England’s heritage” – told Disability News Service this week that it had advised the Cabinet Office on recent access improvements to the building, including a new internal lift, but that so far there had had been no discussions about the steps at the front entrance.Tracey Proudlock, founder of the leading access consultancy Proudlock Associates, and a former government adviser on disability equality, questioned why 10 Downing Street had been handed an award.She said the need to use a ramp at the front door showed that 10 Downing Street had not gone “above and beyond” on access, and she contrasted it with the “great thinking” that had gone into the “creative” access work at Canterbury Cathedral.Proudlock said that front doors are often symbolically important on access.She said: “In terms of Number 10, it is where you deliver your petition or go in to get your new ministerial job.“I think the entrance to Number 10 is really symbolic.“At any front door, disabled people don’t want to be treated differently and that is still happening here.“No matter how quick they are at deploying a temporary ramp, it’s still not an inclusive provision.“Getting out a portable ramp isn’t really a modern approach to providing inclusion.”Proudlock said that just because a building had grade I listed building status, that did not mean that features such as steps to a front door could not be removed.She added: “When big decisions on access are taken, they have to involve disabled people, and at the moment often they do not.”Earlier this year, she wrote in her blog how the Bank of England had come up with an ingenious solution to provide level access at its historic front entrance.She wrote: “If front entrance access can be achieved at the Bank of England – built in 1734, when most disabled people would have been in the workhouse or infirmary – it can be done in a lot more places…“Everyone blames everyone else for why it ‘can’t be done’ or ‘isn’t worth doing’.“Important public buildings, however historic, are no less important to members of the public who happen to be disabled.”A Number 10 spokeswoman said: “Downing Street is committed to accessibility and we have undertaken a programme of works over recent years to make sure this historic building is accessible to all who visit.”This includes improved accessible toilets, “increased ramping”, and a new lift providing access to the state rooms.She said: “We’re proud to have these efforts recognised by the Blue Badge Style Awards.”She said the front door was “manned by a custodian constantly, meaning that it is accessible 24/7 to those who require the use of a ramp”.But she had failed to say by noon today (Thursday) whether there had been any discussions about removing the steps at the front entrance.Historic England confirmed that the Cabinet Office was “rolling out a programme of improvements to the grade I listed complex to proactively address disabled access”.She said: “Historic England advised on the recent installation of the award-winning lift [inside] Downing Street and regularly discusses listed building alterations with Cabinet Office.”Another spokeswoman added later: “There have not yet been any formal discussions with Cabinet Office about alterations specifically to the front steps of Number 10.“The accessibility audit is still being worked through and we will continue to advise as necessary.”Fiona Jarvis (pictured, outside 10 Downing Street), founder of Blue Badge Style and a wheelchair-user herself, said the award recognised the effort made by 10 Downing Street in recent refurbishments.She said in a statement: “They now have stylish toilets for people with disabilities on every floor and stairs that turn into a lift, allowing people with disabilities to get from the main building to the rest of the rooms more easily.“Immediately you arrive they come out with a portable ramp, which means you can negotiate the iconic front steps which are tied by a grade I listing. “More than anything it’s their attitude to doing their best for people with disabilities that won them the award.”Asked why the award had been given when the front entrance was so clearly inaccessible to wheelchair-users, a spokeswoman said that Jarvis “recognises the issue Over 9.01 lakh people (close to 7 per cent of the 1.3 crore screened) were newly identified to have high blood pressure. Of the 97.78 lakh persons screened for diabetes, 8.9 lakh (over 9 per cent) were newly found to have high blood sugar levels. Of 71.85 lakh persons screened for oral cancer, 13,747 tested positive. Cancer epidemic The data released by the Union Health Ministry said 1,495 oral cancer patients were on treatment currently and the newly identified cases are up to ten times higher than the number on treatment. Similarly, over 16.67 lakh women were screened for breast cancer and 12,098 were newly identified to be positive, while only 1,848 women are on treatment. Screening of over 12.26 lakh women for cervical cancer threw up equally alarming figures, with 11, 923 newly identified cases while 872 women are on treatment currently. New heath centres The screening was done at 10,252 health and wellness centres (HWCs) that were opened across the country less than a year ago. These centres are envisioned to provide preventive healthcare and are the first point of contact for a person seeking healthcare in their vicinity. The top States to have started HWCs are Andhra Pradesh (1,361), Tamil Nadu (1,318), Uttar Pradesh (912), Karnataka (700) and Kerala (678). Prime Minister Narendra Modi announced in 2018 than 1.5 lakh HWCs would be opened by 2022 under the Ayushman Bharat plan which also entails extending cashless health insurance to 10 crore families. Opening 1.5 lakh HWCs by 2022 would entail building at least 50,000 HWCs every year in the coming three years. Critics say this is an unrealistic target. Up to 21,411 HWCs have been approved for building till date. “But according to available resources, we can build only 15,000 HWCs this year,” Union Health Secretary Preeti Sudan had earlier told BusinessLine.
